Right now, Amazon has 3 TV shows signed up for this. As a writer, how would you feel about profiting off of someone else's work? Is there a difference between writing "tie-in" works for a TV show, Comic book, Video game, an Author's creations, etc.?
Personally, I think fan fiction using characters and worlds from books should be free. Of course, if the author is all for it, then why not sell it, sharing the profits with the author? However, any works that are "inspired" by books you read, but doesn't use any of those characters, and isn't placed within those worlds, can be published as original works ... because they are original.
Works using characters and worlds of TV shows, Movies, Video games, Comic books, etc. are a bit different, in my book. Provided they aren't based on books. I still feel that if a fanfic writer doesn't have permission to use the characters and worlds, they shouldn't be allowed to make a profit. Those who have permission to sell "tie-in" works, on the other hand, should be making a profit.
The Vampire Diaries TV show is based on books written by L. J. Smith. However she was hired to write them. She does not own the rights.
The Pretty Little Liars TV show is based on books written by Sara Shepard, and the Gossip Girl TV show is based on books written by Cecily von Ziegesar. I've no idea, at this time, if those authors created the characters and worlds, or if they were hired to. I also don't know if they're happy about this deal. I don't know what's in the contracts an author signs when they sell the rights to their works for TV and movies. If I had plans to write and sell my fanfic based on these two shows, I'd only do it if these authors were on board with this deal with Amazon. But that's just me.
